Course Overview

Theory and Techniques for the Advocate and Mediator is an intense three-week/40-hour virtual program that teaches participants the necessary skills about mediation, far beyond the basics. Participants will engage in instruction, mediation simulations and exercises, providing familiarity with the different settings in which mediation is used regardless of one’s role in utilizing it.  Our knowledgeable and skillful facilitators will cover an everything from an introduction to mediation and the necessary steps to prepare for it, to the completion of a mediated agreement. The program will  examine what conflict is, the theory and application of conflict resolution, its role in defining and reconciling interests and how to communicate through conflict.

Participants will be actively involved in interactive simulated mediations with coaches overseeing their role-play, and discussions to better facilitate your understanding of a successful mediation.  Participants will be able to choose between from a general mediation track and a family law track.  The family law track complies with Kentucky Supreme Court Administrative Order 2022-58  and Rule 39/Mediation, Part 5 of Family Court Rules of Practice and Procedure which requires family law mediators to complete a 40-hour mediation training, with either 20 hours of that training or 20 hours of additional training focused on family law mediation including the dynamics of domestic violence and interpersonal violence in relationships.

Because Theory and Techniques for the Advocate and Mediator is entirely virtual through Zoom, participants will utilize NKU’s web based learning management system (LMS) known as Canvas. Canvas helps instructors administer course material, engage with students, and facilitate the learning process. This Canvas course will contain all of the necessary files, videos, discussions, assignments, and any other daily learning materials.  Participants will have homework or pre-work on most days and should be able to dedicate time during the training to complete these exercises. The work includes academic research articles, reading the book Getting To Yes, video presentations, and even work for simulations as you take on the role of an attorney or mediator.

Three learning opportunities available: General Mediation Track, Family Law Track or Supplemental Family Law. Supplemental Family Law is only available for those who have previously completed the General Mediation Track prior to this year.  Supplemental Family Law will begin on Wednesday, October 11, 2023.

Previous participants of NKU’s 40-hour mediation training may register for the family mediation supplement which will start on Wednesday, October 11 and run through Thursday, October 19 .

Course content consists of 40 hours of synchronous (virtual conducted via Zoom) instruction along with several hours of asynchronous preparation (i.e. reading materials, videos and assessments).
