Introduction to Study Aids


What are study aids?

Study Aids are secondary sources that cover specific areas of the law. Unlike casebooks used in law classes, these resources provide explanations, analyses, criticisms, and overviews of legal topics in narrative form. Students can use them to obtain a solid overview of legal topics and to review concepts learned in class. They are particularly useful for students new to the study of law.

The Law Library collects a variety of study aid materials; this handout will help you understand what we offer and where the resources are located. You should review this list and browse the Library's Open Reserve area, as additional items may be placed on Open Reserve by your professor. The most recent version of a study aid is placed on Open Reserve; older editions are moved to Closed Stacks. [Please check with the Circulation Desk if you need any older materials].

What are the various types of study aids?


Treatises

Treatises are works written by legal scholars that cover a specific area of law in great detail. Treatises provide the highest level of analysis and detail and provide extensive references to related sources in footnotes and appendices. They are often multi-volume works, and the author's name is often included in the title; for example, Farnsworth on Contracts.

Depending on the reputation of the work and the author, treatises can be persuasive authority before a court. Treatises are geared towards legal scholars and practitioners, but can also be helpful to law students.

Hornbooks and Concise Hornbooks

Hornbooks are legal texts written expressly for law students by law professors using plain prose. They condense an area of law into a single volume and give a clear overview of the law's evolution, a discussion of courts' interpretation of the law, and an explanation of the application of the law today. There is no clear line of demarcation between treatises and hornbooks, but as a general rule a hornbook is not as detailed as a treatise and provides fewer references to other sources. Accordingly, hornbooks are not considered persuasive by courts and should be used only for background purposes. The 'Concise Hornbook Series' highlights the most crucial issues in a course and offers a more concise analysis of the area of the law. The Series focuses on core principles and concepts fundamental to understanding the subject matter. Both series are published by West.

Examples and Explanations

The Examples and Explanations series combines clear text with examples, explanations, and questions to test your understanding of the material. Sample exam questions with suggested answers are also included. This series is published by Aspen.

Nutshells

Nutshells are short, paperback volumes that present a simple, no-frills overview of an area of law. Nutshells provide few references to other sources and are considered the most basic secondary source on a legal topic. They are quite helpful for non-lawyers and law students just beginning to study an area of law. All nutshells published by West include the word "nutshell" in the title. Never cite a nutshell in a legal document.

The Questions & Answers series is intended to help you to anticipate questions professors might ask in class and prepare well-reasoned answers. This series is published by LexisNexis.
